Welcome to The Himalayan Odyssey! These Terms of Service ("Terms") govern your use of the services provided by The Himalayan Odyssey, including but not limited to travel planning, tour packages, accommodation bookings, and related activities (collectively, the "Services").

These Terms constitute a legally binding agreement between you and The Himalayan Odyssey. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

The Himalayan Odyssey reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically to stay informed of any updates.

2. User Responsibilities

As a user of our Services, you agree to:

• Comply with all applicable local, national, and international laws and regulations.

• Adhere to the itinerary and instructions provided by The Himalayan Odyssey or its representatives during your trip.
• Notify The Himalayan Odyssey promptly of any changes to your contact information or booking details.
• Refrain from engaging in any activity that could harm, disrupt, or impair the functionality or security of our Services or the experience of other travelers.
• Acknowledge that The Himalayan Odyssey is not responsible for any personal injury, loss, or damage to property that occurs due to your own negligence or failure to follow instructions.

3. Intellectual Property

All content, trademarks, logos, service marks, trade names, and other intellectual property displayed or used on the Services, including but not limited to text, graphics, images, photographs, video clips, and software, are the exclusive property of The Himalayan Odyssey or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the Services for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Any unauthorized use of the intellectual property of The Himalayan Odyssey is strictly prohibited and may result in legal action.

4. Termination

The Himalayan Odyssey reserves the right to terminate or suspend your access to all or part of the Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. This includes, but is not limited to, fraudulent activities, violation of laws, or conduct deemed harmful to The Himalayan Odyssey or other users.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account or discontinue your use of the Services, you may do so by ceasing to use the Services and, if applicable, notifying The Himalayan Odyssey in writing.

All provisions of these Terms which by their nature should survive termination, including, without limitation, intellectual property, warranty disclaimers, indemnity, and limitations of liability, shall survive termination.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall The Himalayan Odyssey, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

The total liability of The Himalayan Odyssey for any claim arising out of or relating to these Terms or the Services, regardless of the form of the action, will at all times be limited to the amount paid by you to The Himalayan Odyssey for the specific service from which the liability arose, or USD $100.00, whichever is less.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
